Plumticket Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Plumticket platform (“Platform”), operated by Plumticket (“Company,” “we,” “us,” or “our”). By creating an account or using the Platform, you (“Client,” “you,” or “your”) agree to be bound by these Terms. If you do not agree, do not create an account or use the Platform.
1. Description of the Platform
Plumticket is a ticketing platform that enables client organizations (“Clients”) to create events, sell tickets to the public, and manage in-person sales. The Platform is available at plumticket.com.
2. Eligibility and Account Registration
2.1 You must be at least 18 years of age and have the legal authority to enter into binding agreements on behalf of your organization to use the Platform.
2.2 You agree to provide accurate, current, and complete information during registration and to keep your account information updated.
2.3 You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
2.4 Account approval is required before you may sell paid tickets. We reserve the right to approve or reject any account at our sole discretion. Free events may be published prior to approval.
2.5 We reserve the right to limit the total number of active Client accounts at any time. If registration is at capacity, you may be placed on a waitlist and notified when space becomes available.
3. Platform Fees and Payment Terms
3.1 Buyer Service Fee. A service fee is charged to ticket buyers at the time of purchase. The current fee is displayed to buyers at checkout. This fee is subject to change at our discretion with reasonable notice.
3.2 Client Rebate. You may receive a monthly rebate per paid ticket sold through the Platform where we collect the full Buyer Service Fee. We reserve the right to modify the rebate amount with thirty (30) days' notice.
3.3 No Fee on Free Tickets. No service fee applies to free tickets representing 20% or fewer of total tickets for an event. Free tickets exceeding 20% of an event's total tickets may result in a deduction from your payout as described in the Platform's current pricing documentation.
3.4 Payment Processing. All payment processing is handled through Stripe. You must complete Stripe's Express onboarding and connect a valid bank account before accepting paid ticket sales. Ticket revenue flows directly into your connected Stripe account.
3.5 Refunds. You are solely responsible for processing refunds to buyers. Refunds are processed from your connected Stripe account. We do not issue refunds on your behalf.
4. Your Responsibilities
4.1 You are solely responsible for the events you create, including event content, accuracy of event details, ticket pricing, and fulfillment of obligations to ticket buyers.
4.2 You agree not to use the Platform for any unlawful purpose or in violation of any applicable laws or regulations, including but not limited to consumer protection laws and laws governing public events.
4.3 You agree not to sell tickets to events that are fraudulent, deceptive, or that you do not have authority to promote.
4.4 You are responsible for obtaining all necessary permits, licenses, and approvals required for your events.
4.5 You agree not to use the Platform to sell tickets in excess of actual event capacity.
4.6 You are responsible for compliance with all applicable tax obligations arising from ticket sales through the Platform.
5. Intellectual Property
5.1 You retain ownership of all content you upload to the Platform, including event descriptions, images, and branding materials. By uploading content, you grant us a non-exclusive, royalty-free license to display and use that content solely for the purpose of operating the Platform.
5.2 The Platform, including its design, functionality, and underlying technology, is owned by Plumticket and protected by applicable intellectual property laws. You may not copy, modify, or reverse-engineer any part of the Platform.
6. Prohibited Conduct
You agree not to:
- Use the Platform to engage in any fraudulent or deceptive activity
- Interfere with or disrupt the Platform's operation or infrastructure
- Attempt to gain unauthorized access to any part of the Platform or its systems
- Use automated tools, bots, or scrapers to access the Platform without our written consent
- Resell or sublicense access to the Platform
- Use the Platform in any manner that could damage our reputation or the experience of ticket buyers
7. Prohibited Events and Organizations
7.1 The Platform may not be used to sell tickets to events that involve or promote any of the following:
- Illegal activities or events that violate any applicable federal, state, or local law
- Hate speech, discrimination, or content that promotes violence against any individual or group based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin
- Adult or sexually explicit content
- Events that misrepresent the nature, location, date, or performers in any material way
- Events that have been cancelled without issuing appropriate refunds to prior buyers
7.2 We reserve the right to determine in our sole discretion whether an event or organization violates this section and to remove any non-compliant content and suspend or terminate the associated account without notice.
7.3 You represent and warrant that all events you create comply with this section and with all applicable laws. You agree to indemnify us for any claims arising from your violation of this section.
8. Termination and Suspension
8.1 We may suspend or terminate your account at any time, with or without notice, if we determine that you have violated these Terms, engaged in fraudulent activity, or if continued operation of your account poses a risk to buyers or the Platform.
8.2 You may close your account at any time by contacting us. Closing your account does not relieve you of obligations arising from prior ticket sales.
8.3 Upon termination, your access to the Platform will cease. Any pending rebate payments earned prior to termination will be processed according to the normal monthly schedule.
9. Disclaimers
9.1 The Platform is provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or uninterrupted availability.
9.2 We do not guarantee that the Platform will be error-free or that any errors will be corrected.
9.3 We are not responsible for the acts or omissions of third-party service providers, including Stripe, email delivery providers, or content delivery networks.
10. Limitation of Liability
To the fullest extent permitted by applicable law, Plumticket shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, loss of data, or loss of goodwill, arising out of or related to your use of the Platform, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising out of or related to these Terms or the Platform shall not exceed the total fees we have collected from or on behalf of you in the three (3) months preceding the claim.
11. Indemnification
You agree to indemnify, defend, and hold harmless Plumticket and its officers, directors, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Platform; (b) your events or ticket sales; (c) your violation of these Terms; (d) your violation of any third-party rights; or (e) any defects or service interruptions in the Platform.
12. Governing Law and Dispute Resolution
12.1 These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions.
12.2 Any dispute arising out of or related to these Terms or the Platform shall be resolved exclusively in the state or federal courts located in Cook County, Illinois. You consent to the personal jurisdiction of such courts.
13. Changes to These Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through a notice within the Platform. Your continued use of the Platform after the effective date of any modification constitutes your acceptance of the updated Terms.
14. Miscellaneous
14.1 Entire Agreement. These Terms constitute the entire agreement between you and Plumticket with respect to the Platform and supersede all prior agreements.
14.2 Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
14.3 Waiver. Our failure to enforce any provision of these Terms shall not constitute a waiver of our right to enforce that provision in the future.
14.4 Assignment. You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights without restriction.
